California Supreme Court is Unanimous in Dangerous Condition Case

Martin has won a unanimous victory in the California Supreme Court on behalf of plaintiffs who sued the City of Los Angeles for a dangerous condition of property after their children were killed when their vehicle was forced off the road and hit a magnolia tree planted in the center median dangerously close to a city street. ┬áIn the first opinion authored by newly appointed Justice Leondra Kruger, the Supreme Court reversed the Court of Appeal’s holding that the plaintiffs were required to show the tree caused the negligent third-party conduct that precipitated the underlying accident.
