Ninth Circuit Allows Jail Suicide Case to Proceed

In a published opinion, the Ninth Circuit has allowed a case to proceed against the City of Santa Maria, the Santa Maria Police Department, and individual officers for the attempted suicide of a troubled young man who hung himself with his own belt while left unattended in a holding cell in violation of the department’s own policies. Martin represented the young man, who suffered permanent brain injury and is now unable to communicate or care for himself.

$3.5 Million Wrongful Death Judgment Affirmed

The Court of Appeal has affirmed a $3.5 million judgment for Martin’s clients in a wrongful death action arising from a car accident that killed a 16-year old girl and seriously injured her mother.

Judgment for Design Professionals Reversed

The Court of Appeal has reversed a judgment in favor of an architect and electrical engineer in an action alleging professional negligence for the installation of a battery back-up system in an occupied basement office of a theater.  The batteries overheated and emitted toxic sulfuric gases into the office, causing Martin’s client to develop pulmonary fibrosis.
