RECENT NEWS

The Court of Appeal has reversed a judgment in favor of an architect and electrical engineer in an action alleging professional negligence for the installation of a battery back-up system in an occupied basement office of a theater.  The batteries overheated and emitted toxic sulfuric gases into the office, causing Martin's client to develop pulmonary fibrosis.
The Court of Appeal has reversed the dismissal of a case brought by multiple plaintiffs who alleged that they developed pancreatic cancer from prescription drugs used to treat diabetes.  The Court of Appeal found that the trial court committed error by refusing to consider the plaintiffs' summary judgment evidence and ruling that their state-law claims were preempted by federal law.  Martin represented the plaintiffs on appeal.
The Court of Appeal has affirmed a reduced judgment of $30 million in favor of Martin's client, who was injured by a defective surgical stapler manufactured by a subsidiary of Johnson & Johnson.
